When a publisher goes out of business

What is a writer's legal position in regard to a contract.
If the publisher is not returning calls etc. and cannot be located, is one still bound by it?

That depends on a) what exactly the contract says, and b) what state you're in.

Talk with a lawyer. There's no substitute. And get one who's familiar with publishing law -- it's a specialty.

Yeah, it depends on the contract. Did you sign something yet, or is this hypothetical?
