Crowd Scene Shots

I was wondering something, and if this is the incorrect forum, please let me know. Hypothetically, if you are shooting a crowd scene, for instance, in a night club, do you have to get the permission of each and every person in the audience to use footage of them in your scene? Let's say the club is full of actual people, and not extras or actors. Would it be acceptable to post a sign outside of the club, the night of shooting, to let people know that if they enter, they are giving permission for their image(s) to be used? Just a thought I had, and was wondering. Any comments greatly appreciated.

if you're making a commercial project and you show the face of any individual then you must have them sign a release. it's a standard form that you could probably find online somewhere.

when you see crowd scenes like this in a movie then they are all extras and either work for a meal, $50 or $100/day.

if this is not a commercial project then you are being a creepy filmmaker taking pictures in a nightclub without permission from the nightclub - which you do need btw - and the patrons. you're setting yourself up for a law suit in the law suit happy country.

note: the guy from girls gone wild dvds has gotten numerous law suits for letting minors sign release contracts. yeah, he's creepy!

on this note, I wonder how many of those signatures were signed while under the influence of alcohol....

I do not have a devious nature in mind. The idea a friend of mine had, was to film a live show, that his band plays, and record it for a DVD release. I suggested that he would need to make sure that all legal issues have been looked at. One thing that I thought of, was a crowd. I am sure in a concert style DVD, they don't get release forms from all 10,000 people attending a show. Perhaps it is detailed on their ticket, I don't know. But, if it is a small club, and there is filming, does it just suffice to notify people as they walk in the door, that there will be filming, or, would it be more beneficial to have a waiver form signed? And, if that is the case, would a form, like a petition type form work, or, should it be individual waivers, signed by every person that walks in?

Thanks in advance for the help. I know it sounds a lot harder than it probably really is.
