Ok, he's lost it.


LONDON (Reuters) - Fan sites dedicated to Prince say they have been served legal notice to remove all images of the singer, his lyrics and "anything linked to Prince's likeness," and have vowed to fight what they said was censorship.


What's he trying to do?

I've actually paid to see him twice, and once I took my entire family (kid as young as 6) to see him and bought front-row tickets.

But who sues his fans?

"At no time is Prince suing his fans and this is not about freedom of speech," said John Giacobbi, managing director of Internet policing specialist Web Sheriff.

"The current issue is one between Prince's record label and three unofficial Web sites and relates to the use of Prince trademarks and photographs, many of which are Prince's copyright," he told Reuters.

Sounds like it's more of a spat between companies and less to do with Prince himself. And I think every artist is suing YouTube right now, aren't they? This'll probably blow over quickly. Now on to the real story - how did you afford that many front row tickets to see Prince? And weren't you afraid of anyone getting pregnant just by being that close to him?

4 front row tickets cost $335. Yeah, it was a bit much, but hey, last spring when back in Vegas, my brother-n-law paid $550. for 3 tickets to see the Circue Du Soleil Beatles thing at The Mirage. And then the pictures were another $80. God only knows what my beer cost! Hey, it was a good show, but I almost died when I heard about the cost.

Prince didn't/doesn't/didn't do any nasty stuff when I took my kids to see him. He was going through a religious moment at the time, and even announces that he doesn't use 4-letter words at his shows. Now, I think that's over now. It's hard to do a show in Vegas every night without a little funk, right?

This may be going further than other performers and labels are going, and may well be "anal" behavior, but it looks to me like he's "just defending" his copyrights and trademarks. Song lyrics are copyrighted and cannot be used without permission. Song melodies are copyright and cannot be used without permission. Images and icons are copyrighted and often trademarked by their creators, and cannot be used without permission. I've heard stories from the 1980's of music industry attorneys going after computer bulletin boards that had MIDI files of popular songs for download. Such files are all over the Internet now (though they're completely passe' with the advent of mp3 and similar audio file formats), but they're still copyright infringement.

If you want to see truly outrageous abuse of Intellectual Property law, check out the C&D letters sent out and other actions taken by Monster Cable against a large number of companies with Monster in their names, regardless of the product or service they provide. Monster Cable is trying to claim exclusive rights to the word monster even in areas it doesn't do business, claiming that it "might do business in that area someday."

I agree. And anyone, including a mega-star like Prince, should appreciate publicity.

Everything comes with a price, right? His fans have to have operating expenses to run websites dedicated to him. So what if they sell this or that?

He should be grateful anyone cares who he is.

He also pressured ebay to not allow sellers to peddle Prince stuff on that site. So, let's say I bought a t-shirt ($50?) at one of the concerts I paid to go to, and I realized I don't wear it anymore. I can't sell it on ebay?

What about the CD he gave us at his last concert? He gave our party of four - four free Cd's. We only need one, right? But we can't sell the extra cd's anymore.

Again, we paid something like $85 apiece for concert tickets. So it's not like he didn't get some of my money.

It just seems trivial.

Ah but parody's considered fair use. Hmmmm... go with parody ;).

And the point is that Prince is basically pounding sound in a rathole. (Or pounding rats in a soundhole?)


The internet is constantly refilling what's already there - and adding new stuff infinity.

Trying to fight it is a huge waste of time and actually smells of a psychosis.


I mean, you can watch his videos online at Netflix - 2 or 3 of them are available "watch it now."

Why isn't he suing them?

Perhaps because Netflix pays him royalties?

It might be that Prince is only suing because, technically, he has to pursue every violation to some degree, just to protect his right to do so in the future. Isn't that what happened with J.K. Rowling's publishing company and the Indian church that built a replica of Hogwarts for a local festival? (I'm sure it was discussed in a thread here somewhere.)

Eh. Prince is Prince, and he's a fantastic artist. I'll save my indignation for Phil Collins and Mariah Carey. Sonic sadists!
