No; you've used up "first time rights," but depending on the contract with the English publisher, you could certainly re-sell and republish in the U.S.

Depends what rights you sold. In the past, I've sold the same story under 1st UK Serial Rights in the UK and 1st North American Serial Rights in the US. (plus other foreign language rights where it sold abroad)

These days more and more publications are looking for 1st English Language Rights, or even 1st Worldwide Rights, so best to check your contract and see what it says.

And remember to always check submission guidelines before you submit to make sure you're happy with the publication's rights requirements.

On the assumption that you sold first British serial rights when the story was sold in U.K., you are free to offer first American/Australian/wherever rights. The only problem comes when a piece of work is published on the world wide web because that's world wide rights blown.

If...

you've only sold 1st British Serial rights then you have 1st US/Can/Oz/NZ/SA/UE etc to sell so check your contract. Now find a US mag which is looking for 1st US Rights. They are getting hard to find!
