Legal Topic - Songs as Titles?

Hello,

I'm sorry if this is the wrong area to post this (if it is, please let me know where it should be posted). I have had this idea for a while, and I want to know if it is legal: to use the title of song as the title of a book, and to use that song as inspiration for a story line. For example, "The Beaches of Cheyenne" sung by Garth Brooks (https://genius.com/Garth-brooks-the-beaches-of-cheyenne-lyrics). What if I wrote about this... A girl who loses her guy, she was madly in love, and in the wake of his funeral, she runs to the beaches of cheyenne, where she becomes a legend: the only sign that she is ever aroudn, are her foot prints in the sand. then comes along a new guy who has plans to settle in the small town, and he is intrigued by this "ghost." Eventually, they meet and fall in love.

If that story line is okay, can you provide a story line where it would NOT be okay to write it?

You need to consult an attorney.

That said, you're asking about a hypothetical story you haven't yet written.

Consider changing the details of your inspiration to make it less dependent on the song.
