Re: Taking action

Thank you for the sound advice Dave. Since my book has not yet completed the publication process (thankfully), I would only be participating out of solidarity. I do think that this may be something an individual/group who has had their book sold without receiving royalties from PA might want to do.

CSI was bad as in lame, not bad as in he said anything that would make someone think they should go with PA after reading his posts.

If you do a Google search for "Publish America"...

You will see the Publisher's Weekly articles fourth from the top, which means that they are getting a lot of exposure. Ain't it great?

P.S. Tim thanks, your comments were much appreciated.

Re: PA Big Spenders' List Part III

I couldn't find PA's ad in today's New York Times Book Review, and I don't recall seeing it in last week's edition.

I'm going to drop by the library tomorrow to see if they have a copy of the 21NOV04 edition of the NYTBR, so I can get the names of the October big spenders.

James D Macdonald

Crimes?

For the benefit of <S>Miranda and Larry</S> CIS and Sandy, here are some of the specific charges that PublishAmerica and its principals might find they have to defend against, and where the evidence against them might be found (note: I'm not a lawyer).

Fraudulent inducement
Deception by omission
Deceptive business practices
False advertising

Proof found in: PA's various websites, posts from Infocenter, letters from PA. PA's websites are archived in numerous places, many people have copies of the posts and letters.

Copyright violation

Proof found in: Lightning Source International's printing records (obtainable by subpoena), dates on reversion letters from PA

Fraud

Proof found in: records of PA's royalties paid, records of PA's orders received and shipped (obtainable by subpoena).

Conspiracy

Proof found in: any of the above, provided more than one person was involved, and at least one overt act in furtherance of the crime was performed.

Re: Crimes?

You’re welcome, Ed. I’m just glad that I took the time to participate. All of you guys…you, James, Rebecca, Ann, Dave, Dee, Victoria, Jenna, et cetera, have done so much to help so many (I know I’m forgetting several names, and I’m sorry for that). All of you could have chosen not to bother with enlightening the world about PA—you could’ve all focused on new stories to write—but instead, you took the time to help those that were in the dark…including me.

So…I just want to say thanks…to all of you.

P.S. There are also two other people that I’d like to give special thanks to. Only one of which has frequented this board not long ago: Lynn Price, and Brandilyn Collins. You have no idea how much these women have encouraged me after things with PA started falling through.

Of course, there’s also my wife…but she goes without saying. If not for her, I would have never discovered the wonderful art of writing.

…And…prior to me posting this, I read James’ latest update on PA.

Thanks, James…do you mind if I copy the Crimes? post? Seems that it would come in handy upon contacting the attorney I have in mind.

Happy Holidays everyone!

Re: Taking action and starving trolls

Hey, feel the love. Thanks right back at'cha. For anyone who doesn't have a PW account, I'll copy my latest post from there here:

Carl: "Harry, not one of the people who said that PA sold their books after a reversion of the rights has any proof this actually happened."

Actually, I have proof. I bought a PA book just two weeks ago-- NOT used, NOT from Amazon-- and supposedly the rights had been reversed to the author in March. Please note that Ingram no longer warehouses POD books at all, so there goes that excuse.

That said, I'm amazed that there are some people reading this thread right now who are still on the fence about signing with PublishAmerica. What more do you need? A murder conviction? To sum up one more time...

IF YOU PUBLISH WITH PUBLISH AMERICA...

-You will not see your book stocked in bookstores unless you walk around and beg individual bookstore managers to stock your book-- and even then, you'll have a hard time convincing the managers. Same with libraries.

-Your book will be overpriced.

-You will receive no help with marketing or publicity, perhaps aside from a useless press release.

-You will indeed bear the stigma of publishing with a vanity press. No one in the legitimate literary world considers PublishAmerica a traditional publisher.

-If you dare question PublishAmerica's policies, it is likely that you will be banned from their message boards, ignored by their "support staff," and potentially the target of a smear campaign. In short, you'll get treated just like Carl is trying to treat everyone posting on this thread.

-You will have an extremely hard time getting your book reviewed anywhere that counts.

-Your book will not be edited, aside from a spelling and grammar check done by people who have been proven to be incompetent. Pick up a PA book, play "how many typos can you find?" and get back to me.

-You will receive solicitations from PublishAmerica to buy your own book repeatedly.

-You will be asked to provide contact info for friends and family so PublishAmerica can send them ads for your book; please note that traditional houses give the author many free copies of their books. (None of my family members have ever had to buy my books, and I'd be horrified to know they were being asked to. My family gets free books, courtesy of my publishers.)

-Several libraries will not even take DONATIONS of PublishAmerica books.

Contrary to what Carl is desperately trying to get people to believe, small presses can have big sales. I've published with large and small houses alike, and every one of my books, aside from the three I wrote for the educational market (for sale to schools, not through bookstores) has sold thousands of copies through bookstores.

I make my living as a writer. I've never been a PA author, but I've been trying for a long time to help those who have been deceived by PA. I'm tired of the deceptive language PA uses and tired of seeing authors lose hope and get brainwashed into believing that the traditional publishing world is closed to new voices.

I'm not the only one. I applaud the efforts of Victoria Strauss, Dave Kuzminski, Anne Crispin, James MacDonald, and everyone else who works their tails off to help new authors see the truth about this publisher-- even when there's nothing in it for them aside from the satisfaction of helping someone make a good decision and stay out of trouble. Even when they get attacked by PA zealots in the process (no good deed goes unpunished). And I applaud Publishers Weekly and Steven Zeitchik for taking notice of this important problem.

Now how about looking into some of those claims PA made to Mr. Zeitchik and makes on their website?

--Jenna Glatzer

Funny irony

Right next to that post of mine is a Google bar that says...

Ads by Google
Fiction publishers
Avoid stigma of paying a publisher! We want your book, not your money

Guess whose ad that might be? :lol

I wonder why you never see Simon & Schuster/McGraw-Hill/Random House posting ads on Google begging for writers. Weird, ain't it?

Ed Williams 3

Now, now Jenna...

...it's just one of those odd, coincidental occurences for which there is no explanation, sort of like a UFO sighting....:D

Just for fun, here is the latest from the leader of the PAvidians, HB Marcus, on "stuck-up" (traditionally published) authors...

"Don't ever forget that I will be there for you if you need me. The bashers can get pretty nutty and I have the dope on all eight of them. But they always talk lawsuit and I can't afford that right now. They would have no case, but we would have discover that in court on their dollar. I don't have that kind of time right now.

Give me one week if you're in a rush. Two would be better. I'm almost done with all my family stuff then HB is back in town. Bashers take notice. I've got a lot of karma to burn off."

I don't know about y'all, but I am already taking a sedative to calm my nerves from the impending attack...

:rollin

Re: Crimes?

Happy holidays, Tim.

Sure, you can copy my post. Just remember, I'm not a lawyer. You're doing the right thing talking to someone who is.

Happy holidays, one and all.

[Personal for HB: Only eight "bashers"? Who?]

ProandCon

Big Eight?

Names posted earlier on thread.

1. Rebecca Easton/Dee Power
2. Lynn Price
3. Dave Kuzminski
4. Uncle Jim
5. Ann Crispin
6. Victoria Strauss
7. And I'd throw in a write-in for Diana Hignutt over at Behler.

Mr. Macdonald,

Maybe these are the Big Eight that HB is referencing.
It's good to see the official PA cheerleader, HB, reading AW boards too even though he tells everyone on the PA boards to ignore this site. He always has some excuse why he can't come over and visit the thread. He visits but is too scared to say anything!

HB and Tracy, quit lurking here and speak up. Especially you, Tracy since you bragged about about taking on the biggest PA bashers. Everybody on this thread would love to hear from you.

Joyce amazes me the most. One day, she is crying on the PA boards about PA's No Return Policy and high book prices. The next day she grabs the PA pom poms and leads the cheer. Maybe it's to keep her from crying!

HB, Tracy and Joyce should be ashamed of themselves for leading the new authors down such a dark and dreary path. They should be leading the fight from within PA to advocate for proper treatment of PA authors.

What's that? Oh, I forgot. They would get banned from PA.

I'd like to thank the nice folks over at <a href="http://www.publishamerica.com/cgi-bin/pamessageboard/data/lounge/6746.htm" target="_new">Cocky, stuck up writers</a> for this list -- if it weren't for them I wouldn't have found the PA ad in yesterday's New York Times Book Review. I entirely missed it -- it's just one column (so much for PA's claim that they bought three half-pages), and stuck in the gutter in the far back of the magazine, opposite the classifieds, on page 34.

I did, however, notice the full-page ad from AuthorHouse and the 1/3 page ad from Trafford. Both of those, unlike the PA ad, included blurbs about the books (as did iUniverse's full-page ad, two weeks ago) telling readers why they might want to buy these books.

Once again, PA's ad is missing the ISBNs and prices. Once again, they're missing the subtitles that would clue potential buyers in to the genre of the books. And, sad to say, once again the sales that PA's books are showing through Ingram, B&N, and Amazon can only be described as pathetic. If these are PA's top sellers, one can only imagine how their bottom sellers must be doing.

Thanks, James:

This is something that I should have done a long time ago. I’m not waiting anymore, though. I’m getting my rights back.

I'm curious, what does...

adjusted demand mean?

That marine story seemed to be the biggest seller, and that was what, sixteen last year and eleven this one?

Re: Well...

I remember that Crab Cake dude, wears silly hat in his PA message board avatar. He had some pre-release sales of 500 books or so and obviously kissed enough PA butt to get on the NYT list which obviously, from the numbers he's pumpin' out, was warranted.

That thread was hilarious. Love the cattle cheering their way to the slaughterhouse. "Yay, we're the best, those nay-sayers don't know anything! Hey, what's my head doing on the floor?"

Re: PA Big Spenders' List Part II

Herman X is fly.

Straight from the PA pubby board:

"Hi everyone! I was just wondering about Bob and his web toilet. I have not seen nor heard of him in a while. Can anyone fill me in on his whereabouts? I kind of miss his dry humor. "

Hah!
I'm missed.

Well...

Zaz,

Maybe your good friend Tracy S. will visit you over here since your Suck a Egg comment to her got you exiled. After all, she loves you! You want me to ask her to come visit you?

Platts said on the private board that he was calling it quits in regards to posting on the PA boards. He loves slamming various authors so much that I don't think he'll be gone too long.

I think a few people were sending private emails to the PA Eye crying that their feelings were being hurt by Platts and probably you too.

Don't you miss it?

Further:

From a letter from Janet Morrissey at PublishAmerica to Mr. Munson of the Maryland Attorney General's office:

</BLOCKQUOTE>
It is now clear that PA didn't buy three half-pages. They bought one half-page, and two 2/5 pages.

Per the Times rate card, small-press rate, that's $17,635 plus 2*$14,280, or $46,195 total.

Oh, Ms. Morrissey! Fibbing to the Attorney General? For shame!

Re: PA trolls and 10,000 authors

I've been following this thread for months, checking in daily to find out the latest on what is going on with PA. I read Carl's posts on the PW board and the PA trolls here a few pages back. I have a few general comments I'd like to make about the recent goings-on.

I find it interesting that the trolls appeared at the same time, and then both disappeared just as quickly. I questioned both about their qualifications: were they authors and if so, what were their books, who their publisher was, etc. My point was that if they answered the questions, especially the one about their books, then they might be able to respond with some actual "authority." If they were interested in contributing positively to the discussion, then they might not be trolls. Instead, CSI ignored the questions and just posted inane comments, quickly revealing himself to be a troll. And they weren't even intelligent, thought-out comments. If you're going to argue your side of the issue, why on earth would you say stuff like
"Besides, what good is a watchdog that's too afraid of an intruder to bark?"

And it went on and on. Who were these people? Were there actual meetings at PA about how to deal with Absolute Write, and this was what they came up with??

And now they're gone. PA must be working up their next move. Here's an idea: how about marketing your books to stores?

Then there was Carl at PW. Why he or PA thought anyone could take him seriously is beyond me, especially with his circular reasoning, misspellings and repeated words, like "whiners." He kept ignoring the posted comments like "No, I'm not a PA author" and kept saying that ALL posters there were PA author-whiners.

And now he's gone.

Was this another move by PA to discredit anyone saying anything against them? If so, he was a bad, bad choice as a spokesperson. If anything, the President or CEO of PA should have jumped on that PW board and defended their company (unless "Carl" was the CEO. Isn't that scary?). But they didn't. Now at the PW board is a list of solid reasons NOT to sign with PA, ravings from "Carl," and no response as of yet from PA.

Then there are the PA boards. It seems to me that the authors who are satisfied with what PA has done for them are people who had no real aspirations to become career authors. It is my opinion (and I could be off base) that satisfied PA authors are the ones who wrote their manuscript as a one-time thing, got their names on books thanks to PA, sold it to their friends and family, had said family tell them how absolutely great and wonderful their books were, thereby feeding their egos, and that was it. Then they go on the PA boards to share their excitement with their fellow PA authors about how they're published now. Nobody can buy their books in stores, but that's OK because they're published and that's all that counts.

And that's fine. If that was their goal, more power to them. They got their names on their own books, their friends and family got to read their words, they're happy. Nothing wrong with that.

(I have to insert another question here: do the family and friends actually read the books? If they just had to buy their cousin's $20 book because it was their cousin, would they read it, or just put it on the shelf?)

But it's the other authors who want to pursue writing careers that are having problems, many of whom come here. And they're not whiners. They've been misled by what was advertised as a traditional publisher: a publisher that doesn't market to bookstores, doesn't answer the phone, doesn't respond to emails, and generally doesn't conduct business as a traditional publisher would. I would have been mad too if it were me. And I surely would tell everyone else my experiences.

And what about those 10,000 authors? That means that PA sells at least 10,000 different titles (quite a few more since many authors have more than one book). So, for the sake of argument, let's say PA has 15,000 different titles to sell. PA says that their books are available in brick and mortar stores nationwide. If this were true, then that would mean that my local B&N would sell 15,000 PA books. That's a lot of books in one store from one publisher!

As we all know, the sad truth is most bookstores won't stock PA books or any other POD books. But PA authors don't care to discuss this fact.

On a current thread at PA about the "cocky, stuck-up writers." we see

[Other writers websites] went so far as to say they don't consider me a published author and will never be thier equal. I cannot understand such arrogance from other writers, who think they walk on water.

and

And I tried to advertise my book on [IMDB] to sell some copies and it was pulled also. One guy got through to buy my book anyway. So it is hard out there to get your books sold. My stupid local newspaper has totally ignored my Press Release so far.

Perhaps the Internet Movie Database isn't the best choice to sell a book. Also, the local newspaper, stupid or not, doesn't report news from EVERY press release it gets. It's not a conspiracy, and it's not all about you.

And finally, there's HB:

They think that getting published is their instant excuse to turn up their nose and fake an upper crust persona. Despite how crappy their books sell in the main market they maintain that elitist attitude. Some of the PA authors sell better than their books WITHOUT BEING IN EVERY BOOK STORE IN THE COUNTRY. What's that tell you? They hate us.

Yeah, I hate PA authors, and I turn up my nose at them, too. [NOTE: THIS IS SARCASM.] Does anybody actually believe this guy?

Oh well, too bad! So, they will say anything they can to make it sound like what we've done is less important than what they've done. It's all they have left. We're proof that even traditional publishers make a mistake and some authors write very lousy books.

Since I am a traditionally-published author, I guess that means that they are less important than me, and it is "all I have left." [MORE SARCASM] And I don't want to twist his words around, but it sounds like he's admitting that some PA authors write very lousy books.

And finally,

Besides, if they're such great authors, why are they spending every waking moment bashing PA on the internet and not pumping out books? I do about one book a year and get five star reviews. All they do is whine and have sour grapes about past failings.

Yup, I too spend all my waking hours bashing PA, while PA publishes HB's 5-star books. Then I sit around and whine about my past failings. Sigh.

I find it interesting that HB refers to "whining" here. Anyone else?

[Edited to point out the sarcasm! as]

Underthecity,

No, I don't believe that guy (HB) but your post does make you appear to be elitist. Well, maybe in your mind at least. Does your anger mean that your book was one of the crappy ones with low sales?

Not all PA authors are like HB and there are probably a few PA authors that have sold more books than you have sold.

Fortunately, your venom is not contagious.

Good heavens, P&C -- lighten up! What I took from Underthecity's post was an equal mix of sarcasm and satire, with a healthy dose of sardonic tongue-in-cheek thrown in for good measure.

Re: Now, now Jenna...

Cut down by P&C! Now I really am part of the group!

Thanks Sher2, your review is exactly what I had in mind.

P&C, all this time I've been a bystander to this party, and I wanted to get involved. I'm not a PA author, thank god, nor am I elitist (and I SINCERELY apologize right now if it appeared that I am), and both of my regional history books published by a traditional publisher are still selling very well. If anything, I am proof that an unpublished author can get his work published traditionally and without an agent.

I'm not angry in the slightest. And I put no venom into my posts--intentionally.

[I also edited the post to point out where I wasn't "serious."]

No, I simply don't like to see authors--authors who write just like I do--get shafted by companies like PA. If an author publishes with PA just so his work can get published, just so his name is on a book, and is happy with PA, then fine. That's great for him. He accomplished what he set out to do.

But hundreds of other authors are getting screwed by PA. Many keep quiet, and many are posting here in this thread. And I am finally starting to add my own two cents from my point of view as a published author, instead of just sitting here reading all this and nodding my head.

I also don't like it when people at the PA boards badmouth and generalize legitimately-published authors like myself, saying that we think they are better than they are because we did in fact not sign with PA. If my post had venom, it was directed at them, and "Carl" and trolls like CSI.
