On the other hand, Meyer might just take the MS, tweak it a bit and publish it herself.

Glad you're joking, 'cause legally, Meyer can't do that either. Marian Zimmer Bradley had a nasty run-in with a fan on that count. I remember when it happened in the 90s. Quite the kerfuffle then.

It's not right that this Lady S. could be raking in "orders" right now from the curious or the gullible.

Perhaps she'll use it to hire a lawyer, but it's still theft or fraud. Theft if she keeps the money and doesn't send them a book. Fraud if she never intended to send the book at all.

Hard to tell at this stage whether she's insanely stupid, insanely smart, or just insane.

Does she have a blog? Anyone?

Doesn't this fall into similar territory as the HP Lexicon that JK Rowling had to squash? Since Smeyer "might" continue the series there's a chance of the book impacting future sales of hers (or something like that)? It wouldn't matter if the "fan" version was a hit or not if she potentially costs Smeyer one sale.

What's different about the lexicon book is that they weren't creating new material based on Rowling's characters; they were compiling an encyclopedia-type book that was supposed to be "okay" because it was similar to those Harry Potter and Philosophy type books that only interpret the story. But Rowling mentioned awhile ago she planned on writing an encyclopedia of her own.

This is blatantly taking Meyer's copyrighted and trademarked characters and turning it for profit.

I wonder if Taylor Lautner (sp?) would have cause to sue, too, since she's using his likeness on YT as the background for her advertising/reading. I know actors have successfully sued publications that use their images in advertising without permission.

That falls under Summit's copyright, not necessarily the actor. But yeah, trust me, they won't be happy about it.

This is so far over the line it smells of hoax to me. But the depth of human stupidity, particularly from people who actually have some smarts, never stops amazing me.

He would have no legal recourse unless he has first drawn himself.

He would have no recourse under COPYRIGHT law, but he sure as hell has recourse under his right to publicity. No one can use your image to sell their products without your permission.*

This seriously gives all ficcers bad names. Guess I stepped out just in time? (I never wrote Twilight fic but did write in a crapload of others. ) Course i'm not mental. I know I'm never going to publish them. I've got my own characters for that.
