There's a 'lower'?

The government argues that once rules are set for the new military commissions, the high-value detainees will have military lawyers and "unprecedented" rights to challenge charges against them in that venue.

"How long do you think it will take to get these rules set?"

"It will take as long as it takes."

"How about a ball-park estimate. Six months, a year, what?"

"The situation is fluid. Setting unrealistic timelines would be a mistake, and would play into the hands of the enemy lawyers."

Mmmmm? We beat the sh1t out of this guy's balls and if he reveals this to anyone then it might get back to his buddies that we beat the sh1t out his balls so they might train fellow terrorists that they can expect to have their balls beaten to sh1t? So we don't want it revealed that we beat the sh1t out of his balls.
