If you have had your contract released by PA then this is the place to post the info. I thought this thread would be a good idea so we can try and figure out if there is a rhyme or reason as to who PA is releasing. We could also use the list in any media attention (if the authors don't mind) and any legal disputes. It could also help us have a hands on list of the books released so anybody can try to order the books and see if PA is still printing them. Maybe if PA sells the books on all the ones they release we could get something accomplished legally, this list will make it easier to find those books without going back through the NEPAT threads.

OUTCOME: Full rights reverted back on March 15, 2006

RIGHTS REVERSION REQUESTED: At least twice a year since 2003

DETAILS: Settlement Agreement and Release (with gagging clause) received by registered mail April 2005 - refused to sign.

Registered letter returning full rights received March 25, 2006.

REASON STATED: Breach of Para. 17 (failing to promote sales)

REAL REASON: Who knows? Just a month earlier Jessica emailed me refusing my umpteenth request.

Congratulations to Kevin, Janet, Argile and all recently released authors.

OUTCOME: Full rights reverted Febuary 2006
Cited paragraph 24, I had given up on even getting the rights back after they destroyed the galleys with their "edit" and gave me a horrible cover art. They wouldn't even listen by that time, and completely ignored me. They cancelled several orders just before returning rights.

EDITED:

I just realized the second book was cancelled citing paragraph 25. I have no idea what is contained in that paragraph.

What paragraph, if any, did PA cite as the reason for the release? No specific paragraph was cited. The letter indicated that I was released from the contract at my request, with No disparagement clause attached.

Approximately a week prior to termination I did correspond with PA concerning a clear breach of Section 12 of the contract. They disagreed. I did focus on the following portion:

"Author may, upon giving sufficient notice of no less than seven days, examine Publisher's records and accounts to the extent that such records and accounts are relevant to the publication of the said literary work, which shall be done at Author's expense."

I did remind PA than in no way, shape or form did the above sentence state that travel to Publish America was required. However, PA's blatant violation of section 12 was the final breach. Still, to this day, I haven't received information pursuant to book sales during the most current royalty period--which I clearly offered to pay for (Re: which shall be done at Author's Expense).
