When I looked up the Kindle edition of the new JK Rowling book, The Casual Vacancy, I noticed a curious tag line that says:

"This price was set by the publisher."

I don't think this is related in any way to the DOJ lawsuit/settlement. It's been around for a while.

My guess is it goes back to the beginnings of Agency pricing as a little jab from Amazon but it's not something I've ever looked into.

Yea this has been there for a few years I think. Plus I remember Amazon used to get loads of complaints from customers about the pricing of ebooks when it was because of the agency pricing, it had nothing to do with them.

What the eagle-eyed will notice is that a lot of books which did have "The price was set by the publisher" don't have it any more - that's the fall out of the DOJ suit!
