Favorite sport involving sheepish coffeess is sheep tipping, which should not be attempted without the trademark black rubber gloves.

Okay gang, so, I've been whining about my job, yes?

Came up with what I thought was a brilliant plan to work around my contact person who appeared to be shafting me when it came to quality work headed my way, changed my schedule and it worked last night - hit my optimum goal!

Today, I started work at 11, ran out after 2 hours, got a little more, ran out, got a wee bit more, ran out again. Never before, not even between Christmas and New Year's has work ever, ever, in the five years I've worked for this company, run out like this.

I ran out of work again at 8 pm. Waited for 30 minutes, still nothing. Watched House reruns and new Burn Notice came back out, got a teeny tiny report and while I was typing it, noticed my contact person logged on, then off before I even had time to type out an IM to her. Since then, no work. For 40 minutes, no work.

This sucks major - hubs' job is talking layoffs, potential union strike...

Okay...

A woman plots her brother's death b/c he abused his children - her neice and nephew. Then her brother's junkie wife leaves her with the kids, and she raises them on her own with the full inheritance from her parents.

Ten years later, she's running a successful foundation and home for abused children, providing them with shelter, therapy, and proper education until she finds them loving parents.

Her brother's junkie wife returns with evidence of the murder plot and tries to blackmail her. She doesn't care about her kids, just the money. But the woman refuses to give her sister-in-law the money, so instead, the SIL takes the evidence to the police.

It was premeditated, but justified. The heroine pleads guilty b/c she knows she did the right thing, and she's the heroine, so she won't lie or try to say she's insane or anything. The public is on her side, but the law is clear.

The first few sentences will be "Killing him wasn't the hard part. It was the planning that posed a challenge. She'd always known exactly how she would do it, and gathering the materials she needed wasn't difficult. She wanted him to die knowing she was his killer. She had to make him aware of the actions that had led to that point, and for that, she had to wait. She had to wait for the right opportunity."

Something like that...

Yup. Gotta finish this one first and then do some research. I've previously written women's fiction. this is crime and will require a lot of research. But thanks!

You know the best part? My SO is the one who gave me the idea...and we sat for hours in our bathtub fleshing out different ideas. My ex pretended to care, but he wouldn't talk to me about it. My SO doesn't read or write. He builds things with wood though and just totally gets me. It's awesome, and he's definitely getting credit if this thing gets published! Plus, through his job, he has access to people with connections on both sides of the law, which I'll need!

You realize this means your book ends with your heroine in jail for a very, very long time, right?

It doesn't matter that she thinks it was justified - and I'm not entirely sure how much the public would be with her anyway. You have a couple of problems in this setup, and since you asked I'm just going to lay them out for you:

"Justifiable" homicide is a very different thing in the eyes of the law. You can act to save a life, but under very specific conditions, one of which is that the threat must be immediate. In other words, if she saw her brother was about to kill the kids, with axe upraised if you will, and then she shoots him, then that's likely to be considered justified.

On the other hand, in your scenario, all she has is that he will likely kill them some day if his behavior doesn't change. That is not the same thing at all, especially in the eyes of the law. There are other options in that scenario, and in killing him that way you go from taking a life to save the life of someone else, to flat-out murder.

Let's also consider the matter of the inheritance. Any prosecutor worth their salt is going to hammer away at the money issue. It won't look like she killed her brother to save the kids. What it will look like is she killed him to gain the inheritance. That she devoted her life to kids may count as remorse after the fact, but all that means is that she felt guilty after planning a murder for money. It may win points with the jury, but it won't be enough to get her off the hook.

And once *that* issue is raised, you get into all sorts of other things because now all the money she sank into the place came from a criminal action. The SIL will be legally justified in suing the halfway house your heroine established, and will likely win back the inheritance. Which I suspect would probably bankrupt the halfway house.

So if you're planning on writing a tragedy, I say go for it. Otherwise I would suggest you rethink your central plot device. Have the SIL frame your heroine for the murder or something. Otherwise, once it comes out that your heroine committed a premeditated homicide, add in the inheritance, and she's toast.

The inheritance part isn't necessary. I wasn't even sure I was going to use it.

Another thought I had was that the SIL could blackmail her by asking her to funnel money through her foundation.

I want it to be that she planned the murder, killed him when he was no where near the children. That's what makes the whole thing sticky for the jury.

I don't know if I mind it if she ends up in jail the rest of her life. I'm not sure...I've got some ideas of plot twists in my head...

It's not just sticky, it's insurmountable. Once she's planned it, it becomes First Degree Murder.

These things aren't like items on a menu that you can pick and choose from. There are very clear and well-defined statutes that lay out precisely what counts as what degree of murder. The moment she plans it, her only way out of jail if she ends up in a courtroom - short of some Perry Mason style twist - is for some sort of technicality to get it thrown out. But even that is no guarantee, because at best you get a mistrial, which means the prosecution has the option to retry.

(Or you could have some sort of Presumed Innocent twist, but that involves a framing.)

You want my honest opinion? The murder needs to be an accident, or at the very least something spontaneous. Nothing planned. She gets into an argument or somethng with him, the subject of the kids come up, one thing leads to another, she picks up a hammer lying nearby (maybe they were arguing in a garage near tools) and whacks him.

Then you have wiggle room. She likely still goes to jail, but there become options the jury has because it's no longer so clear cut. Maybe it's only second degree, maybe it even gets dropped to manslaughter. Hell, do it right and maybe it goes back to being justified. And in that case, with just her and her brother for witnesses, you also have more room for that blackmail angle because it is a "he said/she said" bit where he's dead.

Just remember there's a reason the most severe charge of murder is also the only one that involves planning. And a reason most of us don't do it. People who are wired to build homes for abused children are generally not the kind of people who can plan and carry out a murder.

I would also suggest that, since it is not your usual foray, you avoid the courtroom as much as possible. Unless you're going the romantic fiction route where no one much cares about how realistic everything is, there's a whole lot of things you have to know. So if you really want to do this, I suggest you start with a whole lot of research, starting with some basics on criminal law.

Watching CSI or Law and Order does not quite count. :D

She gets into an argument or somethng with him, the subject of the kids come up, one thing leads to another, she picks up a hammer lying nearby (maybe they were arguing in a garage near tools) and whacks him.

Then you have wiggle room. She likely still goes to jail, but there become options the jury has because it's no longer so clear cut. Maybe it's only second degree, maybe it even gets dropped to manslaughter. Hell, do it right and maybe it goes back to being justified. And in that case, with just her and her brother for witnesses, you also have more room for that blackmail angle because it is a "he said/she said" bit where he's dead.

Just remember there's a reason the most severe charge of murder is also the only one that involves planning. And a reason most of us don't do it. People who are wired to build homes for abused children are generally not the kind of people who can plan and carry out a murder.

I would also suggest that, since it is not your usual foray, you avoid the courtroom as much as possible. Unless you're going the romantic fiction route where no one much cares about how realistic everything is, there's a whole lot of things you have to know. So if you really want to do this, I suggest you start with a whole lot of research, starting with some basics on criminal law.

Watching CSI or Law and Order does not quite count. :D

I see your point. I was thinking maybe someone comes and somehow twists the evidence and takes the blame, but...I don't know enough about law, I know.

I don't want any romance in there.

Well, I sent out an email last night to those in power at my job - while I saw both of them logged on this morning, I received no reply to my query of increased work. Checked for available work at 8:30 this morning - nothing. IM'd my contact person, nope, "no work is available. We expect it to pick up again but we don't know when". This won't pay my bills and I have a funny feeling the people who expect my money in their accounts receivable won't take "I'll pay you, I don't know when thought" as payment/in lieu of.

I've put in an application at a national transcription company and let my contact person know I'm looking for alternative employment.

It would be fine as it is, if what I'm making were enough, but with hub's job not looking so solid, I want to be able to sock away some in case we end up without his usual steady income. And that's were the problem is.

It would be nice to work for a company again, instead of being contracted. Benefits are always nice. So is having your taxes automatically deducted.

Depends on how much time you want to invest. If you read quickly, the short route is to read any number of the courtroom writers. Turow's my favorite, and he writes slow enough there's only a few books to go through.

Law and Order actually isn't bad for some of the stuff, like finer points of the law. It's the more dramatic stuff (like threatening someone with the death penalty in New York. No one believes that. Yes, NY has the death penalty but it isn't Texas by a long shot.)

You can also, depending on where you live, simply head down to your local law school and browse through the library. A book on criminal law cases would give you a good background for the kinds of things, and bear in mind those are usually written for first year law students so they aren't too tough to slog through. Most of what's in books is the case opinions, so it's stuff that went to the appellate courts, but that's by far the more interesting.

Might also go and sit in on your local criminal court. You'll see how little of it is actually very exciting - most of it is routine - but even just being in a courtroom gives you a better sense of the feel of it.

There are also a couple of good websites out there that deal with crime and killers, which might also be handy for you. If you wander over into the Mystery section here at AW there's probably some links and such stickied.

I don't write the stuff myself, not exclusively anyway though there are things I've had to research myself, but I read it and watch it (and once upon a time studied it) so my perspective on this is mostly all armchair quarterbacking on my part.

Hope some of that helps.

Yeah, I emailed the administrator, cc'd my contact person my email requesting more work, which explained why I require more work, and how I'd rearranged my schedule to accommodate an increased work load. Still haven't heard back. The last email communication I had with my contact person was to let her know I'll be out of town the last weekend of the month - she got back to me a couple hours later. I'm being avoided.

Oh, well...

Hopefully, I hear back from the place I applied to and they're as loverly and wonderful as the MT chat site proclaims them to be and they really, really want me to work for them.

So her brother's an alcoholic. I all ready have that in my head. What if she makes him drink shot after shot, holds him at gunpoint, then makes him go into the lake, knowing he never learned to swim and is now ridiculously drunk? Kills him with his own disease?

Then, his wife wouldn't have proof unless it's just an eyewitness account.

Which might change my whole story so that I don't really have court....it's more about the actual act...the wife threatening to expose her and destroying her reputation...

I am still just spitting out ideas.

*interrupts*

So we got home yesterday, at last. I did the Kilt's hair, because it had needed cutting for several days. Afterwards, covered with hair shards, I started the shower. The water took what seemed like forever to warm. I turned the handle all the way to the left. The water stopped altogether.

I rang the water people. They said I must have failed to pay a bill. I said that if they sent me a bill, I paid it. They took my number.

Another person from the water company called me back a few minutes later. She insisted I must have failed to pay my bill. I maintained that, if they sent me a bill, I paid it. I asked her to check my account. She told me this would take 45 minutes. I said fine. Call me back when you're done.

She called me back to tell me I was correct. I had no bills outstanding. I'd been away this summer. I should have told them I was away. I asked how that was their business, since I didn't want the water disconnected while I was away.

She told me the person who manages my account noticed my water usage plummeted and assumed I had moved out. So without calling me to say something like ... oh I don't know, 'hey, have you moved out for good?' this account manager cancelled my account. What this person I was talking to could do for me was open a new account. All I had to do was go downstairs on Monday and fill out the form.

Naturally curious at that stage, I asked whether the original bond I had paid when opening my original account could simply be transferred to the new one. But no, my diligent account manager had used the bond I'd paid when opening the account to pay for the disconnection fee and that month's water usage. The water usage, I might add, for which they then sent me the bill and I paid.

I said no. I reconsidered and said hell no. Then I reconsidered again and said that their employee's unilateral decision to close my account without seeing fit to try to contact me was not something I was paying for.

She agreed that it was not really their business what I did with my summer, and that their account manager had perhaps cut a couple of corners that oughtn't have been cut, then turned my hot water back on and told me she's going to speak to the office manager on Monday. Which is tomorrow. So I have to wait until tomorrow before I hear what the office manager says. Bah! :rant:

Okay, you can go back to whatever that was now. I'm done. :D

though I must ask... your water system in Kiwi land must be different than it is here in the states. Here the water in general would just be turned off, because the heat for your hot water comes from a heating unit (usually a hot water heater of some kind) that's located on the premises where you live.

I think having to rely on someone else for *hot* water, in addition to just water, would rather irk me just on principles.

ETA: That's what it would be for normal houses. For apartments we've got a screwy system, apparently. The hot and cold water are both through the same people, but they can only turn off the hot water or something.

Today's been the day for avalanches. We've had 4 so far.

All the snow up on our multi-tiered roof has finally condensed enough in the "warm weather" today (we hit 42) to start coming down in large sheets. We have a metal roof, so it reverbs really well inside the house when it starts to move.

The first avalanche took out the gutters in the front of the house.

Fortunately, there's been no other damage (that we know of) so far, but it really does freak the Staffie-mix to no end.

Yeah, we've been having those. Fortunately it's a short slide and then a two story drop, so as long as no one's walking along the side of the house (my little one is already under instructions to stay away) there should be no cause for worry.

My sympathies to your dog, though, as it *is* a little disconcerting.

I'm probably going to have to go again some time this week, so I figured I may as well do it this way and shop for books relatively pain-free.

I recently upgraded my paints and these are better than the ones I was using before ...

....so I didnt take into account the whole 'since we are better quality, we have better pigments and oh... btw... you're gonna get stoned while you paint' kinda thing...
