Fair enough. I agree that if one feels strongly against Judges doing what is often called "judicial activism" they should feel that way for all types of political decisions Judges make. If they need the US Supreme Court to make these kinds of rulings about affirmative action, then I would concur that the state needs to rethink the extent to which an affirmative action ban has its support in Michigan.
