Writer Alert: Barringer Publishing

Barringer Publishing in Naples, Fla., is refusing to comply with its own contract for the children’s book Rosa Linda and Her Little Pelusita written by a National Writers Union (UAW 1981) member and published on January 30, 2014. The termination clause in the contract reads: “After one year from date of publication, contract may be terminated by either the Author or the Publisher with a 90 day written, certified mail notice at which point all rights shall revert to the Author at the time of such termination. Upon termination, Publisher will immediately remove listing of the Work from its website and all download-based distributors and update that the particular ISBN is out of print.”

In October 2014, the author sent the publisher, Jeff Schlesinger, a demand letter stating that she wanted to terminate the contract. This certified letter, return-receipt-requested, was received by the publisher on Oct. 18, 2014. In an email response, Schlesinger stated: “So glad to be rid of you.” But he has done nothing to comply with the termination. The book is still listed on Barringer’s website and Amazon.com.

A second letter was sent to Schlesinger via Federal Express on June 12, 2015 with five explicit demands. As of October 9, 2015, he has yet to comply with the termination clause of the contract.

The NWU recommends that writers take this situation into account before working with Barringer Publishing
