I figured P&CE would be interested in a report on what happened today in the oral arguments in Obergefell v Hodges, a case that will probably come to be seen as one of the major landmark civil rights cases in US History.

The court is considering two questions here…
1.Does the Fourteenth Amendment require a state to license a marriage between two people of the same sex?
2.Does the Fourteenth Amendment require a state to recognize a marriage between two people of the same sex when their marriage was lawfully licensed and performed out-of-state?
I know in past discussions here there have been some concerns that the court isn't on the same page as the general population on this issue, but I still think the court will answer both questions in the affirmative. It all comes down to Kennedy, and while he may be pretty conservative on specific issues, his recent record on gay rights issues is actually very strongly in favor.
We should see a final decision made in June 2015.
