HIPAA does not apply because the judge is not a medical professional and not bound by HIPAA.

Ugh, I used to BE a medical professional and should know that. One more awful thing about this situation.

I have no idea why sexual history is still being considered relevant in rape. That should be a thing of the past.


My guess is that the judge looked at this as a rape only because of the age only that. However, even if that were the case, which it isn't there's this:

And not only does her saying "no" make it rape, the fact that he was a 20-year-old adult and she a 14-year-old child also makes it (statutory) rape.

So therefore a well deserved WTF.

Judge Carter Thompson has granted the state's motion to re-impose all sex offender conditions on Sir Young.

The judge also told Young he won't be getting any more chances.
So he'll have to stay away from children, get evaluated as a sex offender and undergo treatment, and avoid watching porn. It's the most the judge could have done, given Judge Howard's sentence.

The mother of a teenage rape victim told The Dallas Morning News on Wednesday that she will file a judicial complaint against the judge who gave her daughter’s attacker probation and then publicly bashed the girl.
The woman, who is not being named to protect her daughter’s identity, said the judge overstepped her authority when she told The News in an interview last week that the girl “wasn’t the victim she claimed to be.” The mother said the judge needed training and to officially be told that what she said was wrong.
