The rights grab happens as soon as they submit, regardless of whether they win, regardless of whether they later sign a contract...
...and most importantly, regardless of whether or not they understood what they were signing away and what the implications of that were.
It's not as simple of "if you don't like the terms, don't enter", because that only applies to the people who are savvy enough to read and understand the terms, and what they mean for the future of that work.
