Canada's top court will rule this morning on a case that could challenge Canada's infanticide law and reignite the abortion debate.

Levkovic told police she had fallen, gone into labour and given birth to a stillborn child. She then put the body in a garbage bag and left it on her balcony.

Levkovic was charged with concealing the body of a child. The Criminal Code provision on infanticide dictates an individual cannot conceal the birth of a “child,” whether it died “before, during or after birth.

A lower court struck the word "before," calling it vague as Levkovic was acquitted. An Appeal Court reversed that decision and ordered a new trial.
