Blackwater slapped with a lawsuit

The Center for Constitutional Rights in New York, which has played a key role in several high-profile cases against the Bush administration involving detainee policies and warrantless wiretapping, has just announced a suit against Blackwater USA.

The group is representing an injured survivor and the families of three killed during the controversial shootings last month:

Blackwater USA, the private military contractor whose heavily armed personnel allegedly opened fire on innocent Iraqi civilians in Nisoor Square in Baghdad on Sept. 16, was sued today by an injured survivor and three families of men killed in the incident, according to the legal team representing the civilians. The case was brought be the Center for Constitutional Rights and the firms of Burke O'Neil LLC and Akeel & Valentine, P.C.

Filed in Washington, D.C. federal court by Talib Mutlaq Deewan and the estates of the deceased men - Himoud Saed Atban, Usama Fadhil Abbass, and Oday Ismail Ibraheem - the lawsuit alleges that Blackwater and its affiliated companies violated U.S. law and "created and fostered a culture of lawlessness amongst its employees, encouraging them to act in the company's financial interests at the expense of innocent human life."


The complaint alleges that Blackwater violated the federal Alien Tort Statute in committing extrajudicial killing and war crimes, and that Blackwater should be liable for claims of assault and battery, wrongful death, intentional and negligent infliction of emotional distress, and negligent hiring, training and supervision.

I hope those Iraqi families win.

A senior foreign policy adviser to leading Democratic presidential candidate Barack Obama has told The Nation that if elected Obama will not "rule out" using private security companies like Blackwater Worldwide in Iraq. The adviser also said that Obama does not plan to sign on to legislation that seeks to ban the use of these forces in US war zones by January 2009, when a new President will be sworn in.

Obama's broader Iraq withdrawal plan provides for some US troops to remain in Iraq - how many his advisors won't say. But it's clear that Obama's "Follow-on force" will include a robust security force to protect US personnel in Iraq...

Contrast this with something Hillary's Senate office put out...

Senator Clinton Cosponsors Legislation to Ban Use of Private Security Contractors in Iraq and Afghanistan

Washington, DC - Senator Hillary Rodham Clinton announced today that she has cosponsored legislation to ban the use of Blackwater and other private mercenary firms in Iraq.

"From this war's very beginning, this administration has permitted thousands of heavily-armed military contractors to march through Iraq without any law or court to rein them in or hold them accountable. These private security contractors have been reckless and have compromised our mission in Iraq. The time to show these contractors the door is long past due. We need to stop filling the coffers of contractors in Iraq, and make sure that armed personnel in Iraq are fully accountable to the U.S. government and follow the chain of command," said Senator Clinton.

The legislation requires that all personnel at any U.S. diplomatic or consular mission in Iraq be provided security services only by Federal Government Personnel. It also includes a whistleblower clause to protect contract personnel who uncover contract violations, criminal actions, or human rights abuses.

I think everyone would like to see a change in some directions, some policies, and the overall political climate of Washington in general, but, regardless of what B.O. Hillary, or McCain may say to the contrary, the U.S may modify, but hardly full boat change the status quote in Iraq. BlackWater plays for real, and to a large degree its been the private security firms that scare the hell out of the insurgency, because they don't have to play by the same rules as the military.

Thing is, guys, you have to really push politicians to do the right thing. Just because Obama hasn't "ruled out" using mercenaries, that doesn't mean he will, despite what that Nation reporter (and incidentally MyDD) thinks.

And considering he's (him being the reporter) scolding Hillary for mysteriously "changing" her position on mercenaries a day after the article is posted and wanting their use banned, he automatically damages his own credibility right there.

Shades of Bill Clinton handcuffing the intelligence community by not allowing the CIA to use certain resources.

Mercs are here to stay. They've been around longer than the USA has been. We'll still use them no matter what a candidate says.

Slight corrections to Blackwater being the only security contractors (armed), both DynCorp International, Triple Canopy also have major contracts in the war zones.

Since the mid- ‘40s the DOD, CIA and other agencies, have hired and used what you call contract employees in a war zone/dangerous area, mercenaries.
All the Vietnam era Air America folks were mercenaries, etc., etc.

ETA: I am sure there are many more we don't know about.
