The Dervaes Family of Pasadena, California have been known in the world of home gardening for years. They write books, hold workshops, speak and lecture, and are particularly outspoken against GMO crops.

This past October the Derveas Family secured a trademark on those two words (when they are linked together as one whole phrase, as well as trademarks on a slew of other phrases) and they are now sending out letters to various bloggers and commercial web sites asking them to stop using those words unless they properly cite that combination of those two words as being the exclusive trademark of the Dervaes Family.

Meanwhile ... virtually all US states have "homesteading laws" on their books, and no less than 3 US states have subclauses in their respective laws referring to a very special type of homesteadng known as the "urban" kind. And those states even have legal forms available, designating (un)said category of homesteading. (What the Dervaes Family intends to do about the on-going publication of such forms by those state governments, I have no idea.)

Meanwhile Part II ..... back in 2008, two authors, Kelly Coyne and Erik Knutzen, published a book called [CENSORED!!]. And now Amazon is being "asked" by the Dervaes Faimly to remove the page-links and search triggers which use those forbidden words in association with that book.

Meanwhile, Part III ........... the Dervaes Family has successfully gotten Facebook to take down many many many many many Facebook pages that have violated their trademark, including the very popular Facebook page of a significant group known as The Oakland Institue of [CENSORED!].

Meanwhile Part IV ........... the backlash from the vast movement of home gardeners, organic enthusiasts, anti-GMO folks, anti-seed patenting folks, and various stripes of "homesteaders" (including the urban kind) are just about 100% unanimous in their pissed-off-ed-ness. This includes a new Facebook page called Dump the Dervaes, and a petition to get the trademark overturned.

The Dervaes Family has said in their defense that these are not actual "cease and desist letters" they have been sending out, and anyone who claims they are is lying. They have further said that they have the purest of intentions here because they are merely trying to prevent those important phrases from falling into the hands of huge capitlaist pig companies like Monsanto, etc.

Who thinks they can trademark two english words that describe an activity that anyone could engage in, and then legally go after a book published using those words in its title before they filed for that trademark, and then get Facebook to take down mentions of the book with this bogus legal claim?

Why, "urban homesteading"™ pioneers the Dervaeses, of Pasadena, California.
IP as currently legislated has serious problems.

As an IP law enthusiast I'd have to agree.

But the law isn't the problem in this example. It's people's understanding of the law ... and examples like this will just make more and more people understand it.

Quite sensibly the law permits people to trademark common phrases and words as legal trademarks - as long as the terms aren't inherently descriptive of the product.

So I can trademark 'Yoghurt Computer' but not 'Fast Computers'. That's what Apple did - take a common word and trademark it for computers. It also covers associated areas ... so I couldn't have a computer servicing centre called 'Apple' without their permission.

That's perfectly sensible. What wouldn't be sensible is if Apple decided to send nasty-grams to every fruit manufacturer on the planet and tell them that they needed to put a little 'TM' after the word Apple.

There are plenty of examples where phrases that are common in an industry get a certain specialised trademark in a certain instance -- so someone has trademarked 'Final Draft' for the name of a specialised word processor .. but that doesn't stop people from using the phrase to describe the drafts of their projects.

Should 'Urban Homestead' have been permitted as a trademark in this instance ? Probably not ... but no matter what the rules are it is guaranteed that dozens of mistakes are going to make it through every year. That's just part of life.

One way to improve the system is to update the ethics rules for lawyers and start enforcing them. So a lawyer could be brought up on an ethics violation if they send out nasty-grams that they know (or should reasonably know) are baseless.

Another good way would be to streamline the system to get a trademark revoked ... so people can act to stop the nasty-grams from happening to others.

Even with those cases - in house lawyers make stupid decisions. When Virgin airlines opened in Australia their inhouse legal system automatically churned out plenty of nastygrams warning anyone else with the word 'Virgin' in their name to keep out of their business. It could have been a perfectly good marketing effort - a simple 'Hi - We are opening 200 business centres across the country and will have a big TV marketting campaign - but I noticed we have slightly similar names. I trust there won't be any confusion given the fact we are likely to be in very different businesses but if you want more information we have a webpage at XXXXX giving full details of our trademark rules. Give us a call on XXXX if you have any problems and if you want great lowcost airfairs just visit our website'.

It could have been a good letter ... but instead their inane legal department basically threatened to sue nuns because they used the word 'Virgin' in the name of their church group !!! Not a very good PR move!

Thankfully it was stopped pretty quickly - but it is surprising how few organisations control their legal departments from making big PR stuffups.

All kinds of books use all kinds of phrases in their titles, some of which are trademarked. And yet Coke didn't go after Faith No More for calling one of their albums "The Real Thing."

I went ahead and clicked the link just now -- it's NOT (as I assumed) a link to the Amazon web page for the book itself. Instead, it's a link to the "search results page" in the Amazon search engine that comes up with the words "Kelly" and "Coyne" together. This is total bullshit! They are essentailly demanding that Kelly Coyne's NAME no longer be affiliated with the book. They want to obliterate all traces of the book's existence, including depriving her "bookography" even being allowed to list that book. This is downright sick! The Reason magazine article that Don linked up above mentioned a lawsuit by Kelly Coyne's publsher using the word "malicious" in its accusatins. At first I dismissed the usage of the word "malicious" as overblown lawyer posturing. But now I feel the word-choice of "malicious" is more than appropriate here.

There's a whole new kind of low-cost property available in this country . . . and people who are willing to invest a little time, effort, and money are getting some great bargains.


Urban Homesteading


A hundred years ago, "go west, young man" was good advice .. . after all, the western sky was big and clear, and land was free for the taking. Well, the Homestead Act was repealed in 1976, and there isn't any more undeveloped "free land" to be had in the United States. But—as many people are discovering—it's still possible to homestead ... in the heart of many American cities! And in these days of fuel shortages and transportation problems, folks with urban jobs are finding out that "citysteading" can be energy-efficient and—in general—not a bad idea at all!

Urban homesteading programs—which allow people to purchase (for a dollar down!) and renovate decaying urban properties—came about as a response to the metropolitan housing crisis of the late 1960's. About that time, the middle-class flight to the suburbs had led to an increased need for city services on the part of the poor who remained behind . . . and taxes rose as the tax base fell.

Many landlords—neglecting required maintenance—squeezed the last penny from their properties and then walked away from back-tax bills. The abandoned buildings began to blight entire neighborhoods, more and more property dropped from the tax rolls, and the cycle of vandalism and arson took hold.

The original citysteading programs—which started in 1973 in Wilmington, Delaware ... Philadelphia, Pennsylvania ... and Baltimore, Maryland—were begun to help break the cycle of urban decline. Then, in 1974, the federal government entered the picture with the passage of the Housing and Community Development Act ... and the stockpile of federally owned homes (most of which resulted from defaults on FHA mortgages) joined the numbers of municipally owned taxdelinquent buildings. By 1975, demonstration programs were underway in 23 cities . . . and now, nearly 90 urban areas participate!


HOW IT WORKS

MOTHER recently sent staffer Peter Hemingson to Baltimore to observe the workings of what's generally considered one of the best urban homesteading programs. Both city-owned and federally repossessed houses are included in the Chesapeake Bay city's setup, and—while some requirements differ from one piece of property to another—the general homesteading procedure is the same.

The Baltimore Department of Housing and Community Development selectsfrom a pool of tax-delinquent homes, FHA foreclosures, and buildings acquired in urban development programs-houses that are suitable for renovation. The list of properties is announced, and the public is invited to apply for their purchase. (The Baltimore program has no residency requirements, but some city programs do have such limitations.)

Here's the Wikipedia entry for the bio on the family patriarch, Jules Dervaes. (I didn't know until I read this Wikipedia article that the family was from a fringe-y Christian group. But they did strike me as being a very different sort of anti-establishment.)

Read it while you can as I'm sure the content of this Wikipedia page will change by lunch time. (Take special notice of the hyperlink in the Wikipdia article for the term "urban homesteading" -- it links to ANOTHER Wikipedia article that was originaly published in Wiipedia back in 2009).

Jules Dervaes (born 1947) is an urban farmer and a proponent of the most recent wave of the decades old urban homesteading movement.

Dervaes runs Path to Freedom, a website about self-sufficiency and urban gardening.

Trademark Controversy

In 2008, the Dervaes filed to trademark the terms "urban homestead" and "urban homesteading," among others. In October 2010 their trademark was finally approved under the supplemental registry after initially being denied for not being distinctive enough. In 2011 they began sending notifications to maintainers of websites who used these terms that these terms were now under their trademark and that they were not to be used without crediting the Dervaes family. Critics (such as blogger Crunchy Chicken) claim that this trademark is unenforceable, since the term "urban homestead" has been in use since at least the early 1970s.

The Dervaes Institute asserts that it's protecting a legitimate business interest, and that its trademark of the term "urban homesteading" prevents other corporations from trademarking it.

This has caused an uproar within the urban homesteading community and created a backlash against the Dervaes family. A diverse group of urban homesteaders are planning a day of blogging about the situation on Monday, 21 Feb 2010, and the Electronic Frontier Foundation has gotten involved[10].

On February 16, 2011, the Dervaes shut down their Facebook page, blaming the negative press stemming from this controversy.

Yes, that negative press. How naughty it's been. It's all the negative press fault, not because they were being greedy and trying to snap up all the phrases for themselves that were around years before they came onto the scene.

The person who agreed to their trademark should be slapped as well.

i'm sure path to freedom is a book about michael collins.

edit: ooh, a quick google search showed that there is not only several books called that, but there's a drug rehabilitation centre in surrey and a couple of documentaries called that made by the mighty BBC.

I would LOVE to see them try to take on the BBC.

Tomorrow, February 21st, has been declared "Urban Homesteaders Day" by a reactionary Facebook group that popped up less than a week ago in response to the Dervaes Family Trademark Controversy, and also in repsonse to all the Facebook pages that have been taken down.

The plan is to deliberately blanket the entire internet as of tomorrow with the phrases "Urban Homestead" and "Urban Homesteading." I can only assume it is an attempt to thwart all future efforts by the Dervaes Family to conduct any more meaningful web searches for their trademarked phrases by overloading the Dervaeses meager search capabilities.
